The GEP/ASMTP is quota-free and non-sector specific. Applicants who possess special skills, knowledge, or experience of value to and not readily available in the HKSAR may apply to come to work under the GEP/ASMTP. For GEP/ASMTP, the Immigration Department will assess on the education background (principally first degree in the relevant field or technical qualifications or professional abilities), genuine job vacancy in the Company, confirmed offer of employment, special skills, knowledge, or experience of value to and not readily available in the HKSAR, and remuneration package offered.

Please note that GEP does not apply to Chinese residents of the mainland, and nationals of Afghanistan, Cuba, Laos, North Korea, Nepal and Vietnam. For Chinese residents of the mainland, please apply through Admission Scheme for Mainland Talents and Professionals.

Non-local students holding valid visas who have obtained an undergraduate or higher qualification in a full-time and locally accredited local programme in Hong Kong or persons who have obtained an undergraduate or higher qualification in a full-time programme offered by the GBA* campus of a Hong Kong university may apply to stay/return/come and work in the HKSAR under the “Immigration Arrangements for Non-local Graduates” (IANG).

IMPORTANT NOTE: The Investment as Entrepreneur Visa is different from the GEP/ASMTP in major regards. Applicant who wishes to apply for Investment Visa under GEP are advised to read all following information before applying.

An Investment Visa is a special type of visa under the GEP who is granted to applicants who wishes to establish or join in business in the HKSAR. The applicant is in a position to make substantial contribution to the economy of the HKSAR, with consideration factors including, but not limited to, business plan, business turnover, financial resources, investment sum, number of jobs created locally and introduction of new technology or skills.

Please note that GEP does not apply to Chinese residents of the Mainland, and nationals of Afghanistan, Cuba, Laos, North Korea, Nepal and Vietnam. For Chinese residents of the Mainland, please apply through Admission Scheme for Mainland Talents and Professionals.

Unlike CIES, a high amount of capital injected into the Company or holding several properties in the Company’s name does not immediately guarantee the approval of the visa. While the CIES is focusing on the total capital injected to the Hong Kong economy, the investment visa focuses on investment and entrepreneurship as a whole.

Major points for Consideration include the comprehensiveness of the business plan, business turnover of the Company, financial sustainability, overall available financial resources, total investment sum, number of jobs created locally and introduction of new technology and skills.

The Scheme seeks to attract highly skilled or talented persons to settle in Hong Kong to enhance Hong Kong’s economic competitiveness. Successful applicants are not required to have secured an offer of local employment before their entry to Hong Kong for settlement. All applicants are required to fulfil a set of prerequisites before they can be awarded points under one of the two points-based tests, namely the General Points Test and Achievement-based Points Test, and compete for quota allocation with other applicants.

For the ease of understanding, prerequisites to be fulfilled include all of the following

If the applicant fails to provide satisfactory supporting documents showing that he/she meets all the above prerequisites, his/her application will not be processed further and will be refused immediately.

Applicants who have met all the prerequisites may choose to be assessed either under the General Points Test or Achievement-based Points Test. There are six point-scoring factors under the General Points Test and one point-scoring factor under the Achievement-based Points Test. A minimum passing mark is set under the General Points Test. Persons who choose the Achievement-based Points Test are advised to assess whether their credentials are adequate to meet the minimum passing mark before applying. The Prevailing passing mark is 80. Applicants with scores higher than the passing mark will be ranked and higher ones will be shortlisted for further assessment.

Achievement-based Points Test

The Scheme also caters for the entry of individuals with exceptional talent or skill who have outstanding achievements. They may choose to be assessed under a separate Achievement-based Points Test. Requirement under this test is very high. Those who are considered to have met one of the criteria under this test listed in the following paragraph will be awarded 245 points; otherwise, no point will be awarded. Applications which fail to score points under this test will be refused immediately.

Points may be awarded under this test if:

⦁ the applicant has received an award of exceptional achievement (e.g. Olympic medals, Nobel prize, national/international awards); or
⦁ the applicant can show that his/her work has been acknowledged by his/her peers or has contributed significantly to the development of his/her field (e.g. lifetime achievement award from industry).

 

Successful applicants under the Scheme may bring their spouse and unmarried dependent children under the age of 18 to Hong Kong provided that they are capable of supporting and accommodating their dependants on their own financial resources without relying on public assistance in Hong Kong.

The Scheme is not applicable to nationals of Afghanistan, Cuba, Laos, Korea (Democratic People's Republic of), Nepal and Vietnam.

Technology Talent Admission Scheme (TechTAS)

Technology Talent Admission Scheme (TechTAS)

TechTAS provides a fast-track arrangement for eligible companies to admit non-local technology talent to undertake research and development (R&D) work for them in the HKSAR. Eligible companies would first have to apply for a quota. A company allotted with a quota by the Innovation and Technology Commission (ITC) can accordingly sponsor an eligible person to apply for an employment visa/entry permit within the 24-month quota validity period.

 

Automation and optimisation concept, business process workflow development

In addition to the general conditions set out in the GEP/ASMTP, there are two additional points that is paramount for the application:

⦁ The applicant should be engaged principally in conducting R&D in the areas of advanced communication technologies, artificial intelligence, biotechnology, cybersecurity, data analytics, digital entertainment, financial technologies, green technology, integrated circuit design, Internet-of-Things, material science, microelectronics, quantum technology or robotics.

⦁ The applicant is a degree-holder in science, technology, engineering, or mathematics (STEM) from a well-recognised university, which is among the top 100 universities for STEM-related subjects in the latest publication of any of the following world university ranking tables:

If you are born overseas to Hong Kong Permanent Residents and currently residing overseas and wish to work in Hong Kong, this may suit your need. Other criteria would be:

⦁ between 18 and 40
⦁ having at least one parent who is holder of a valid Hong Kong Permanent Identity Card
⦁ having a good education background
⦁ proficient in written and spoken Chinese (Putonghua or Cantonese) or English
⦁ have sufficient financial means and are able to meet the living expenses without applying for social security

This Scheme is not applicable to applicants who are nationals of Afghanistan, Cuba, Laos, Korea (Democratic People’s Republic of), Nepal and Vietnam.

Student Visa

Student Visa

If you are a student under 20 years of age looking for secondary or below education in Hong Kong you may wish to apply for a student visa.

Once you have been accepted by an institution, you must get a student visa or entry permit. All non-local students need one, whether they come for an exchange programme or full-time studies. In general, non-local students should nominate a local sponsor, which can either be the educational institution granting the acceptance or an individual and provide the necessary supporting documents. Normally, the Immigration Department requires the following documents, while further supporting documents and information in connection with the application may still be required when necessary. It will normally take six weeks to process a visa or entry permit application for study upon receipt of all the required documents – apply as far in advance as possible!

If you take up studies in a full-time locally accredited local or non-local post-secondary programme, you will normally be granted a length of stay in line with the normal duration of your study programme, subject to a maximum period of six years upon entry and the validity of the travel document held. For those studying other courses, they will normally be granted permission of stay for 12 months upon entry or in accordance with the duration of their studies, whichever is shorter. You may apply for extension of stay, if necessary, within 4 weeks before their limit of stay expires to continue their study in the HKSAR. Such applications will be considered only when the applicants continue to meet the eligibility criteria for entry for study. Extension of stay, if approved, will normally be on a yearly basis or in accordance with the duration of their studies, as appropriate.

Where a document is not in Chinese or English, it must be accompanied by a Chinese or English translation certified as a true translation by a sworn translator, court translator, authorised public translator, certified translator, expert translator, or official translator.

Immigration Arrangements for Non-local Graduates (IANG)


If you are non-local university graduates looking for employment as professional in Hong Kong, you may apply so under the IANG. The university degree should be obtained from local universities or higher education institutions. However, if you have studied in Greater Bay Area Universities and Colleges, you may also apply for IANG.

The IANG is quota-free and non-sector specific.

The IANG does not apply to nationals of Afghanistan, Cuba, Laos, Korea (Democratic People’s Republic of) and Nepal. For nationals of Vietnam, the GBA Campus rule is not applicable.

Non-local graduates who submit applications to the Immigration Department within six months after the date of their graduation (i.e. the date shown on their graduation certificates) are classified as non-local recent graduates.
Non-local graduates who submit applications beyond six months of the date of their graduation are classified as non-local non-recent graduates.

GBA campus graduates who submit applications to the Immigration Department within six months after the date of their graduation (i.e. the date shown on their graduation certificates) are classified as GBA campus recent graduates.

GBA campus graduates who submit applications beyond six months of the date of their graduation are classified as GBA campus non-recent graduates.

For sake of understanding, GBA here shall mean The Guangdong-Hong Kong-Macao Greater Bay Area (Greater Bay Area), which comprises the two Special Administrative Regions of Hong Kong and Macao, and the nine municipalities of Guangzhou, Shenzhen, Zhuhai, Foshan, Huizhou, Dongguan, Zhongshan, Jiangmen and Zhaoqing in Guangdong Province.

Upon Approval of Visa, the Applicant will normally be allowed for 24 months’ stay on time limitation only without other conditions of stay provided that normal immigration requirements are met.

Dependants

Dependants

For a sponsor who has been admitted into the HKSAR under GEP / ASMTP (either for employment or investment purposes), or studies (in a full-time undergraduate or post-graduate local programme in a local degree-awarding institution), the Quality Migrant Admission Scheme, the Admission Scheme for the Second Generation of Chinese Hong Kong Permanent Residents or the Top Talent Pass Scheme, the dependants may apply to join him/her for residence in the HKSAR. Hong Kong permanent resident can also apply for their dependants to stay in Hong Kong.

For sake of clarity, dependants is defined as the following;

⦁ spouse; or the other party to a “same-sex marriage”
⦁ unmarried dependent child under the age of 18
⦁ his/her parent aged 60 or above.

The Application will be assessed on reasonable proof of a genuine relationship between the applicant and the sponsor, no known record to the detriment of the applicant and the sponsor’s ability to support the dependant’s living at a standard well above the subsistence level and provide him/her with suitable accommodation in the HKSAR.

This entry arrangement does not apply to:
⦁ Chinese residents of the Mainland of China (the Mainland) [except for those whose sponsors have been admitted to take up relevant visas];
⦁ Former Mainland Chinese residents residing in the Macao Special Administrative Region (SAR) who have obtained Macao identity cards for less than seven years, unless they have acquired residence in the Macao SAR through the One-way Permit Scheme; and
⦁ Nationals of Afghanistan and North Korea.

Extension of stay

Extension of stay

Extension of Stay would often come up in the period of stay in Hong Kong, as the visa approved will expire after a certain period. Depending on the class of visa applied, there could be different requirements in Extension of Stay. Extension of stay in the HKSAR shall be applied within 4 weeks before their limit of stay expires. Such applications will be considered only where it is satisfied that the circumstances upon which the applicant acquired his/her current immigration status remain unchanged.

Under the current Immigration policy, there are six categories of people who are eligible to apply for the permanent residence in Hong Kong, primarily:

⦁ For Chinese Citizens:

⦁ Chinese citizen who has ordinarily resided in Hong Kong for a continuous period of not less than seven years before or after the establishment of the HKSAR;
⦁ A person of Chinese nationality born outside Hong Kong before or after the establishment of the HKSAR to a parent who, at the time of birth of that person, was a Chinese citizen falling within category above.
The person’s right of abode by virtue of being a permanent resident of the HKSAR under category in (b) can only be exercised by holding:
⦁ a valid travel document and a valid Certificate of Entitlement affixed to the travel document;
⦁ a valid HKSAR passport issued to him/her; or
⦁ a valid permanent identity card issued to him/her.

⦁ For Non-Chinese Citizens:

⦁ A person who has entered Hong Kong with a valid travel document, and has ordinarily resided in Hong Kong for a continuous period of not less than seven years
⦁ A person under 21 years of age born in Hong Kong to a parent who is a permanent resident of the HKSAR before or after the establishment of the HKSAR.
⦁ A person other than those in all the categories listed above, who, before the establishment of the HKSAR, had the right of abode in Hong Kong only.

Please note that the continuous period of not less than seven years shall mean a period of seven years counting from the date of application, and within these seven years the applicant shall not be absent from Hong Kong for more than 36 months in total, and none of the absence period shall be over 6 months.

Application for Naturalisation as a Chinese National

Under the relevant regulations, any persons who wishes to apply for HKSAR passport must first obtain Chinese Nationality. Naturalization provides a way for non-Chinese citizens who obtained the permanent residence in Hong Kong.

Documents Required:

⦁ For Applicants over 18, photocopy of below:

⦁ Hong Kong identity card
⦁ birth certificate
⦁ passport(s) or travel document(s) showing his/her travel records and length of residence in Hong Kong
⦁ letters from employers certifying the periods of his/her employment with them.
⦁ letters from schools or other educational establishments showing the periods he/she attended.
⦁ tax returns or a letter from the Inland Revenue Department showing that he/she has paid taxes in the past years.
⦁ any other document showing his/her residence in Hong Kong
⦁ proof of his/her relationship with the near relative who supports the application (if applicable), including proof of the relative’s HKSAR Passport and a Hong Kong permanent identity card.
⦁ proof of his/her ‘other reasons’ if he/she has completed Part 11 of the application form.

⦁ For Applicants under 18, photocopy of below

⦁ birth certificate
⦁ passport(s) or travel document(s) showing his/her travel records and length of residence in Hong Kong or letters from schools or other educational establishments showing the periods he/she attended.
⦁ proof of relationship with his/her parents or legal guardian, e.g., his/her birth certificate, parents’ marriage certificate, court order granting guardianship (if the application is submitted by a legal guardian)
⦁ financial proofs of his/her parents or legal guardian e.g., tax returns
⦁ proof of his/her relationship with the near relative who supports the application (if applicable),
⦁ proof of his/her ‘other reasons’ if he/she has completed Part 11 of the application form.

The Chinese nationality law does not allow multiple nationalities for any Chinese individuals. So, the process would involve two parts, application of Chinese nationality and renunciation of original nationality. The process could take at least 15 months’ time from application to finish.

Once naturalization process is complete, there would be a certificate of Naturalization issued. Please take extra care as this certificate would be needed for application of the first HKSAR passport, and NO REPLACEMENT will be issued if the certificate is defaced, damaged, or lost for any reason.

Please note the 36-month absence rule holds for all residents who have gained Permanent Residence Status before. The PR status will be suspended if this rule is violated.

Foreign Domestic Helpers (FDH)

Foreign Domestic Helpers (FDH)

IMPORTANT: Helpers are not admitted to Hong Kong for settlement. They are not eligible to bring their dependants to Hong Kong for residence.

This entry arrangement does not apply to Chinese Residents of the Mainland, Macao and Taiwan as well as nationals of Afghanistan, Cuba, Laos, North Korea, Nepal and Vietnam.

A Helper must be in possession of a proper visa before he/she travels to the HKSAR. The issuance of a visa to individual Helper is subject to the normal immigration requirements being met (such as holding a valid travel document with adequate returnability to his/her country of residence or citizenship; be of clear criminal record and raises no security or criminal concerns to the HKSAR, has no likelihood of becoming a burden on the HKSAR; etc). Employers who satisfy the criteria for FDH visa should not assume that their Helper’s visa application would be approved automatically.

The employer seeking for FDH visa must be financially capable of employing a Helper after his/her household expenditure has been deducted. In general, for every Helper to be employed, the employer must have a household income of no less than HK$15,000 per month or assets of comparable amount to support the employment of a Helper for the whole contractual period. The Helper and the employer shall enter a standard Employment Contract and shall perform domestic duties ONLY under the employment contract. No other employment with any other person is allowed. The Helper shall work and reside in the employer’s residence with suitable accommodation and reasonable privacy.

⦁ Bank statement showing auto-payment of the monthly salary for the last 3 months.
⦁ Salary statements/slips issued by the employer’s company for the last 3 months.
⦁ Evidence showing that the employer is in control of substantial assets for the past 6 months (with an aggregated amount of no less than HK$350,000)

⦁ If the employer is self-employed or a company director:

⦁ Latest notice of assessment and demand for tax
⦁ Company Profits Tax Assessment and BR Certificate
⦁ Bank reference letter showing banking facilities granted to the employer’s company is in control of substantial assets for the past 6 months (with an aggregated amount of no less than HK$350,000)
